Financial institutions in Europe and the United States are considering a range of products to address their funding needs while questions still remain regarding the products that will achieve beneficial regulatory capital treatment. Various national regulators also have provided guidance regarding additional or "buffer" capital, as well as contingent capital products. We have seen a few issuances of contingent capital products by European banks and anticipate additional offerings will be forthcoming. The speakers will address a number of topics, including the following:

  • Basel III guidance;
  • Status of Basel III implementation;
  • Bail-in capital;
  • National guidance on bail-in capital;
  • Contingent capital product (a discussion of various alternative structures);
  • Market experience;
  • Tax considerations, ratings consideration, corporate governance and other considerations relating to contingent capital; and
  • Investor perspective.
