Alistair Maughan

Alistair Maughan is a partner in the firm’s London office.  He is co-chair of the Technology Transactions Group and a member of the Global Sourcing Group.

Mr. Maughan focuses on commercial contracts and technology-based projects for major companies and public sector organizations.  His primary areas of expertise include advising on: commercial licensing and sales contracts in the UK and Europe; service-based outsourcing transactions; technology delivery models such as cloud and as-a-service platforms; contracts for the supply and acquisition of technology equipment, services and software; agency and distribution contracts; advising on issues and contracts related to e-commerce; counselling public bodies on procurement policy and procedures; and drafting, negotiating and advising on all types of technology contracts and issues.

His notable transactions include advising Her Majesty’s Revenue & Customs on Europe's largest “second generation” outsourcing; advising the UK police on its national fingerprint identification system and its project for the delivery and operation of the national UK emergency mobile radio network; advising the world's largest insurance broker on offshore outsourcing; and other transactions on behalf of banks, global pharmaceutical companies and major professional services firms.

He has advised on commercial product sales, distribution and supply chain logistics agreements for clients as diverse as UPS (global delivery and logistics company); AIG (global insurer); Novartis (global pharma business); Otto Group (large German retailer); ElectraTherm (innovative U.S.-based provider of heat-from-waste generators); LogiXML (U.S. software company); and Panasonic (major Japanese electronics manufacturer).

He has also advised on a number of infrastructure and public/private partnership projects, especially in relation to telecommunications networks and PPP projects in Europe.

Mr. Maughan is a highly regarded commercial lawyer with recommendations in Legal 500, Chambers Global, Chambers UK, Euromoney’s Expert Guides and PLC Which lawyer? 2010, leading independent guides to the legal profession.  Chambers UK awarded Mr. Maughan the top ranking for both Outsourcing and Information Technology, commenting that he “brings common sense to the negotiating table.”  Other guides note that Mr. Maughan is “the best outsourcing lawyer ever when it comes to acting for the customer end of the market” and “absolutely excellent when it comes to advising customers on public sector projects.”  He is also named in the 2009 UK edition of Best Lawyers.

Mr. Maughan has a law degree from Leicester University, and qualified as a solicitor in 1987.  He has practiced law on both sides of the Atlantic and is also admitted to the New York Bar.

HM Revenue and Customs
Advising HM Revenue & Customs, the UK's central taxing authority, on the merger of two major outsourcing contracts and the ensuing integration exercises. The project arose through the merger of two separate government departments to create HRMC. The project followed on from work on the Inland Revenue's outsourcing re-procurement exercise. (2006)
Sun Life of Canada Business Process Outsourcing.
Advised closed-book and pensions provider, Sun Life of Canada, on a second-generation business process outsourcing of policy administration services to Diligenta, the UK subsidiary of Tata Consultancy Services. (2007)
UK Borders Agency.
Advised the UK Borders Agency on its £297 million business process outsourcing contract. Services in scope include the establishment of physical rise applications centres; provision of information services; the acceptability to enroll the biometric details of all NSA applicants; and the secure transmission of all NSA applicant details. Over 200 countries are in scope to receive services. This project won the award for "e-Government excellence" at the e-Government National Awards. (2007; and ongoing)
National Policing Improvement Agency.
We advised the National Policing Improvement Agency (NPIA) on a major upgrade to NPIA's contract with Airwave Services that will allow police officers to use their radios while operating anywhere on the London Underground. This project was a major extension to NPIA's core network services contract supporting all of the UK's emergency services radio platform, also a Morrison & Foerster project.
