Please join us at Morrison & Foerster for a seminar looking at recent regulatory developments in the EU on structured products and their likely impact on future structured products.
In the aftermath of the subprime crisis, Lehman’s bankruptcy and the ensuing global financial crisis, structured products, particularly those marketed to retail investors (such as PRIPs and UCITS) and private funds, have come under close scrutiny. Regulators, politicians and industry associations have produced a number of consultations and initiatives for reform, which are designed to help speed the revival of confidence in the structured products markets, by addressing the perceived shortcomings in structured products. Their proposals involve, among others, enhanced disclosure, reforms of the structuring, marketing and transparency of certain structured products and proposed homogenisation of regulations affecting retail investment products contained in different “wrappers”. We will look at key regulatory and industry developments, including an update on the work of the Joint Associations Committee on Retail Structured Products, as well as the likely impact of the proposed changes on future structured products.
Topics Will Include:
- EU initiatives on retail structured products, including PRIPs and UCITS
- Update on FSA Retail Distribution Review
- Update on the work of the Joint Associations Committee on Retail Structured Products
- Impact of proposed EU AIFM Directive
- The “foreign private adviser” exemption under the new US Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010
