John Adams is an associate in Morrison & Foerster's London office and a member of the Litigation Group. He practices in general commercial litigation and dispute resolution.
Mr. Adams advises on a wide range of commercial litigation matters, including contractual disputes, professional negligence, financial disputes, civil fraud claims, and insolvency matters. Mr. Adams works with a range of small to large private companies, which include companies in the banking, insurance, and music and entertainment industries. Mr. Adams also works with trustees in bankruptcy and liquidators on insolvency matters.
Over the past three years, Mr. Adams has acted for a group of music and entertainment suppliers/distributors in relation to the administration of ten companies, in order to recover stock pursuant to retention of title clauses contained within their terms and conditions, which was supplied to the insolvent companies. He has also acted for a number of trustees in bankruptcy and liquidators to recover and sell assets for the benefit of creditors.
As a result of the work Mr. Adams and other members of his team have done in relation to the enforcement of a retention-of-title clause against administrators, particularly following the administration of Music Zone Limited, administrators are less likely to raise arguments regarding the validity of a retention-of-title clause where the goods have been mixed with the same or similar goods of another supplier.
