Julie O'Neill counsels clients in all areas of state and federal consumer protection law. This includes the review of online and offline advertising, competitor and regulator challenges, sweepstakes and other promotions, and all forms of direct marketing (including behavioral advertising, email, SMS, telemarketing, fax advertising, and direct mail). She also advises clients on compliance with state and federal privacy, information security, and database breach notification laws, including the Federal Trade Commission (FTC) Act, Gramm-Leach-Bliley Act, Fair Credit Reporting Act (FCRA), Fair and Accurate Credit Transactions Act (FACTA), and the Children's Online Privacy Protection Act (COPPA). In addition, Ms. O'Neill works with clients on the lawful transfer of personal information from the European Union to the United States.
Ms. O'Neill also assists clients with the creation of compliance programs for the laws regulating the collection, use, and disclosure of customers' and employees' personal information. She helps companies draft privacy policies, Web site terms of use, agreements involving marketing practices, and agreements involving the collection, sharing, and use of personal data.
Ms. O'Neill previously served as a staff attorney in the FTC's New York regional office, where she investigated violations of federal antitrust and consumer protection law. She is recommended by Legal 500 US 2012 in the areas of data protection and privacy and marketing and advertising.
