Kevin Calia’s practice includes securities, antitrust, and general commercial litigation. He has experience representing public companies and their officers and directors in securities class actions, derivative actions, SEC investigations, internal investigations, and other litigation in state and federal courts.
Mr. Calia successfully briefed and argued an appeal in the Federal Circuit on a constitutional issue of first impression, securing a ruling that veterans applying for service-connected disability benefits have a constitutional right to a fundamentally fair adjudication of their claims. Cushman v. Shinseki, 576 F.3d 1290 (Fed. Cir. 2009). In 2010, Mr. Calia received a California Lawyer Attorney of the Year Award for his work on this matter.
Mr. Calia has worked extensively with damages experts in securities class actions, written and argued motions in federal and state courts, filed appellate briefs in the Ninth Circuit, the Tenth Circuit, and the Federal Circuit, taken and defended depositions, and managed large document collection and review projects.
Mr. Calia graduated from Stanford Law School and earned his undergraduate degree from the University of California at Davis.
Mr. Calia's representative engagements include the following:
- Represented Level 3 in an appeal in which the dismissal of the securities class action was affirmed. In re Level 3 Communications Inc. Securities Litigation, 667 F.3d 1331 (10th Cir. 2012). Represented Level 3 in related derivative litigation in Colorado.
- Represented a group of companies that sell fruit juice products in multidistrict litigation proceedings that were dismissed because the plaintiffs could not show they had suffered injury. In re Fruit Juice Products Marketing & Sales Practices Litigation, 831 F. Supp. 2d 507 (D. Mass. 2011).
- Represent Seiko Epson Corporation and its affiliates in multidistrict antitrust litigation regarding TFT-LCD products (flat panel displays) in the Northern District of California.
- Represent a social gaming company and its officers and directors in securities class actions and related derivative litigation in the Northern District of California and San Francisco Superior Court.
- Represent a biopharmaceutical company and some of its officers and directors in a securities class action in the Northern District of California.
- Represented a pharmaceutical wholesaler and its officers and directors in derivative litigation in San Francisco Superior Court.
- Represented the officers and directors of an energy company in derivative litigation in Contra Costa Superior Court.
- Represented a provider of mutual funds in a securities class action in the Northern District of California.
