Did you know that New York is deputizing private citizens in tax recovery and applying qui tam to state tax actions? New York's law is fundamentally different than the IRS Whistleblower Program provisions. Liability under the new law may be imposed on either fraudulent or simply false claims for payment or approval. Moreover, penalties may be extended beyond taxpayers to preparers as well as advisers.
