Paul Flum's practice focuses on complex litigation and class actions. He represents plaintiffs and defendants in federal and state trial and appellate courts. Mr. Flum's clients include telecommunications companies, software developers, transportation companies, pharmaceutical wholesalers, accounting firms, and financial services companies. Mr. Flum has handled matters across diverse substantive areas, including federal and state securities laws, state privacy and consumer protection laws, employment disputes, RICO, ERISA, and various business torts.

Mr. Flum received his B.A. from the University of Minnesota in 1979. He received his J.D. from the University of Minnesota Law School in 1982, where he served as an editor of the law review. He joined Morrison & Foerster in 1982.

Mr. Flum has represented plaintiffs and defendants in a variety of commercial and tort actions, including claims for fraud, breach of contract, breach of fiduciary duty, and defamation.

Mr. Flum currently represents the plan sponsor and individual defendants in this federal class action for breach of fiduciary duty in connection with retirement plan investments in the employer’s stock.

In re JDSU ERISA Litigation

Mr. Flum defended the plan sponsor and individual defendants in this federal class action for breach of fiduciary duty in connection with retirement plan investments in the employer’s stock.

In re Calpine ERISA Litigation

Mr. Flum defended the plan sponsor in this federal class action for breach of fiduciary duty in connection with retirement plan investments in the employer’s stock.

In re McKesson Governmental Entities AWP Litigation

Mr. Flum currently represents McKesson Corporation in these federal class actions asserting RICO claims on behalf of various classes of public and private payors.

Walter v. Sitrick

Mr. Flum currently represents the fiduciaries of an ESOP in defending against ERISA in connection with the redemption of the ESOP’s shares.

Bickar v. United Parcel Service

Mr. Flum represented UPS in this action brought in California superior court on behalf of a class of managers challenging the company’s vacation accrual policies.

Youngberg v. Bank of America

Mr. Flum defended Bank of America in this class action brought in California superior court on behalf of a class of personal trust customers.

Alfaro v. Consolidated Freightways
