The SEC faced substantial criticism following the Madoff scandal and the financial crisis. Robert Khuzami, a former DOJ prosecutor, was hired to fix its enforcement program. The SEC’s self-described transformation has been a slow process but finally is nearing completion. Now the SEC -- armed with a new structure, internal policies and procedures, laws, and an improved esprit de corps – is ready to get moving and is showing a new aggressive attitude. Public companies and their lawyers need to know what to expect from, and how to respond to, this new SEC.
