Our kickoff program will focus on the “Responsible Corporate Officer” Doctrine and related life sciences white collar criminal issues. In recent years, the United States Department of Justice has prioritized the investigation and prosecution of pharmaceutical and life sciences companies for unlawful promotion and marketing of products for off-label use. Individual executives and employees also have been held responsible. The presentation will cover the types of conduct and activities that the government has targeted, review the recent prosecutions, examine the red flags that companies should keep an eye out for, and outline the measures that companies can adopt to prevent and defend against government investigations and prosecutions. MoFo partner Adam Hoffinger, recently quoted on this topic in The Wall Street Journal, will be our featured speaker. Mr. Hoffinger has successfully defended companies and individuals in these cases at both the pre-indictment and trial stages.
