Ms. Tarlton's presentation will survey recent developments and interesting cases relating to the intersection of trademark law and free speech, including nominative fair use, parody and satire, and use of marks in titles, creative works, and domain names, as well as on auction sites. Her discussion will include the recent ruling by the Eastern District of California refusing to grant a TRO against use of the logo created by Courage Campaign, which parodied the logo used by California Renewal in the context of a Proposition 8 dispute in ProtectMarriage.com v. Courage Campaign.
