The Appellate Advocacy Class at UC Berkeley School of Law (formerly Boalt Hall) has selected a Morrison & Foerster appeal as its class project for this year. The case, Ralphs Grocery Company v. UFCW Local 8, now pending before the California Supreme Court, involves the constitutionality of two state statutes limiting the jurisdiction of California courts to issue injunctive relief.

On September 14th, Miriam Vogel and Timothy Ryan, who won this case in the Court of Appeal and are representing Ralphs Grocery Company before the California Supreme Court, will present a lecture to the class and answer questions regarding the case.

By the end of the semester, the class (divided into separate groups representing the appellant and respondent) will have briefed the case based on an abbreviated edition of the actual record and participated in oral argument. This is the second law school to use the Ralphs case as its class problem. UC Davis School of Law used the case last semester.

Ralphs v UFCW Local 8 is one of the most closely watched cases on the Supreme Court’s docket. The appeal is fully briefed and waiting for an oral argument date.
