The Dodd-Frank Act created the Consumer Financial Protection Bureau and gave it broad authority to regulate unfair, deceptive and abusive acts and practices (UDAAP). Other banking regulators are paying attention and taking a page from the CFPB's playbook. Dodd-Frank added a new abusive prong to the FTC's traditional Section 5 UDAP analysis, and the CFPB and other regulators have made clear that they intend to view all bank practices through a new consumer-oriented lens. What is UDAAP? How will banking regulators find it? What types of practices have regulators targeted so far?
