Teva v. Sandoz
(Southern District of New York). Successfully represented the manufacturer of a generic version of Copaxone in a three-week trial under the Hatch-Waxman Act. On appeal, the Federal Circuit invalidated the patent with the longest remaining term, allowing the client to launch its generic product more than one year earlier than expected.
Allergan v. Sandoz
(District of Delaware). Represented Sandoz regarding the company’s application to sell trospium chloride, resulting in the invalidation of all asserted claims.
Euro-Diagnostica AB, et al. v. Inova Diagnostics, Inc.
(Southern District of California). Representing Axis-Shield, Euro-Diagnostica, and STW in patent litigation asserting infringement of Axis-Shield’s, Euro-Diagnostica’s, and STW's rights to patents relating to diagnostic assays for the detection of rheumatoid arthritis.
Elan Pharma International Limited v. Abraxis Bioscience
(District of Delaware). Representing Abraxis BioScience, Inc., against Elan Pharma International, Ltd., in patent litigation involving Abraxis’ albumin-bound paclitaxel for treatment of metastatic breast cancer.
General Atomics (Diazyme Division) v. Axis-Shielf ASA
(Northern District of California). Represented General Atomics’ Diazyme Laboratories Division in winning summary judgment of noninfringement by Diazyme’s enzymatic homocysteine assay under two separate infringement theories against Axis-Shield ASA.
The Regents of the University of California v. Monsanto Corporation
(Northern District of California). Represented the Regents of the University of California in litigation against Monsanto Corporation leading to a settlement of more than $200 million for a license to the University of California’s patents covering bovine growth hormone.
Nichols Institute Diagnostics, Inc. v. Scantibodies Clinical Laboratory, Inc.
(Southern District of California). Represented Scantibodies Laboratories, Inc., against Nichols Institute Diagnostics, Inc., resulting in jury verdicts of invalidity and noninfringement by Scantibodies’ parathyroid hormone assay, and a finding of anticipation by the Federal Circuit.
