Mr. Brun joined Morrison & Foerster LLP in 2003 and is a partner in the Litigation Department of the San Francisco office. He focuses his practice on intellectual property, technology, and complex commercial matters. Mr. Brun has litigated a wide range of intellectual property and technology-related matters, including patent cases involving microlithographic imaging of circuit pattern layers, optical alignment systems, Internet hypertext links, object-oriented software, the combination of Global Positioning System and cellular telephone technologies, thin-film read/write heads for computer disk drives, and the broadcast of interactive television applications. He has drafted and negotiated various commercial agreements in the areas of technology licensing (both software and hardware), software/technology distribution, software development, professional services, and strategic partnerships. Mr. Brun has also performed IP diligence in support of clients’ merger and acquisition activities, and has advised clients in securing and preserving intellectual property rights.
Mr. Brun came to Morrison & Foerster from firm client, OpenTV, Inc. At OpenTV, Mr. Brun counseled company executives and engineers on a broad range of intellectual property and commercial matters. He represented the company in its participation in international standards organizations, and negotiated and drafted various commercial agreements on behalf of OpenTV. In addition, Mr. Brun managed the company’s day-to-day patent prosecution activities, conducted infringement analyses of both third party and company products, performed IP diligence in support of the company’s merger and acquisition activities, and oversaw patent, and other, litigation matters.
Prior to joining OpenTV, Mr. Brun served as corporate counsel for another Morrison & Foerster client, NBC Internet, Inc. While at NBCi, Mr. Brun provided the primary legal support for the company’s business development and intellectual property matters. Among other things, he renegotiated the company’s master services agreements with various bandwidth providers, oversaw the IP diligence in connection with the National Broadcasting Company’s buyout of NBCi, and managed the company’s technology-related litigation matters.
Prior to joining NBCi, Mr. Brun was an associate with the law firm of Preston, Gates & Ellis in San Francisco, where he represented both emerging growth and established companies in an array of patent, copyright, trademark, and Internet-related matters, from both a litigation and transactional perspective.
Mr. Brun received his B.S. in Industrial Engineering from the University of Arkansas in 1990. He then joined Andersen Consulting (now Accenture) as a commercial manufacturing consultant/engineer. Mr. Brun received his J.D. from the University of California, Hastings College of the Law in 1995.
