Norman R. Klivans, Jr. engages in a practice focused on patent prosecution, litigation, counseling and licensing issues facing technology companies. His technical expertise encompasses an array of electronic products and processes, including semiconductors, semiconductor equipment, lithography, computer peripherals, automotive electronics, lasers, optical communications, telephony, computer networks, Internet and software.
Mr. Klivans practiced general law for several years and then went to Stanford University Graduate School of Business. He obtained an MBA in 1978 and then worked in the electronics industry. In 1987, he returned to legal practice with the law firm of Skjerven Morrill and became a partner at that firm in 1992.
Mr. Klivans is a member of the State Bar of California, the Silicon Valley Intellectual Property Law Association and is registered to practice before the United States Patent and Trademark Office.
Representative Matters
- In the technical field of data communications and broadcasting, Mr.Klivans prepared and prosecuted a series of patents in the US and abroad for Command Audio Corp. The prosecution has involved several appeals in the US and oppositions in Europe. The patents are currently being asserted against Sony Corp. in a lawsuit in the US.
- Prior to joining Morrison & Foerster, Mr. Klivans represented Xilinx Corp. in a series of patent infringement cases against Altera Corp. involving field programmable gate arrays. This involved two ITC actions and two lawsuits in US District Court and extended from 1997 to 2001.
- Mr. Klivan's patent preparation and prosecution work in the semiconductor industry has included representing Siliconix Inc., Micrel, Advanced Micro Devices, National Semiconductor Corp. and Xilinx Corp. In the semiconductor equipment field, he has done patent work for Nikon Corp., Schlumberger (now NP Test) and Etec Systems. He has worked on matters involving optics, conventional and electron beam lithography, semiconductor materials, device physics, superconductivity, semiconductor design tools, semiconductor devices.
