Ketanji Brown Jackson is a litigator at Morrison & Foerster LLP with substantial experience in handling cases on appeal before the U.S. Court of Appeals for the District of Columbia Circuit. Ms. Jackson’s practice focuses on appellate litigation in both state and federal courts, as well as litigation in the Supreme Court of the United States.

Ms. Jackson worked as an Assistant Federal Public Defender in the appeals division of the Office of the Federal Public Defender in the District of Columbia from 2005 until 2007. Ms. Jackson argued half a dozen cases in the D.C. Circuit, and she authored numerous briefs and a petition for writ of certiorari involving significant issues of criminal law and procedure. Ms. Jackson’s professional experience includes work as an Assistant Special Counsel of the United States Sentencing Commission, where she drafted amendments to the federal sentencing guidelines, and as an associate with two boutique law firms, one specializing in white-collar criminal defense, the other focusing on the negotiated settlement of mass-tort claims.

Ms. Jackson received an A.B., magna cum laude, in Government from Harvard-Radcliffe College, and a J.D., cum laude, from Harvard Law School, where she served as a Supervising Editor of the Harvard Law Review. She also served as a law clerk to three federal judges, including Associate Justice Stephen G. Breyer of the Supreme Court of the United States.

  • Boumediene v. Bush, Nos. 06-1195, 06-1196 (pending). Amicus brief on behalf of 20 former federal judges arguing that the current detention review process for Guantanamo detainees is unconstitutional because it may permit reliance on statements obtained through torture.
  • Quanta Computer, Inc. v. LG Electronics, Inc., 128 S. Ct. 2109 (2008). Brief for Gen-Probe Incorporated arguing that the authorized sale of a patented article exhausts the patent-holder’s patent rights in regard to the item sold, and that conditions on the use of such an article after sale are enforceable only by contract.
  • Clark County, Nevada v. Vacation Village, Inc., No. 07-373 (pending). Brief for five associations representing all components of the air transportation industry – the Air Line Pilots Association, International, the Air Transport Association of American, Inc., the Aircrafts Owners and Pilots Association, Airports Council International-North America, and the Regional Airline Association – in support of a petition for a writ of certiorari regarding federal preemption of state takings claims that would frustrate reasonable regulation of land use around airports.
  • Hall Street Associates v. Mattel, Inc., No. 06-989 (pending). Brief for Mattel, Inc. regarding whether the Federal Arbitration Act permits parties to expand the grounds on which a court may vacate or modify an arbitration award under Sections 10 and 11 of the Act.
