International Chamber of Commerce
- Lead trial counsel for a European company in an ICC arbitration in Korea filed by its former supplier, which demanded over $40 million in damages. The Tribunal rejected the supplier’s claims and awarded no damages.
- Lead trial counsel for a Korean company in an ICC arbitration in London arising from a Middle East construction project. . The Tribunal rejected 90% of the claims asserted by the opposing party, issuing an award that resulted in no liability for the Korean company after taking set-offs into account.
- Represented a large Korean conglomerate in an ICC arbitration arising from a technology transfer agreement with a U.S. company, which had demanded over $28 million in damages. This dispute settled on favorable terms after an initial hearing in Singapore.
- Represented a Japanese company in an ICC arbitration in Tokyo arising out of a stock purchase agreement. The Tribunal accepted the Japanese company’s claim for over $30 million in damages, and also awarded substantial attorneys’ fees.
- Co-counsel for a Korean bank that asserted claims exceeding a total of $1 billion in two related ICC arbitrations in New York. Both arbitrations were settled on favorable terms shortly before the final hearing.
- Co-counsel for a Korean company in an ICC arbitration in New York against its former overseas partner. The Tribunal awarded over $90 million in damages to the Korean company.
- Counsel for four other ICC arbitrations, venued in Seoul, Singapore, and Paris.
Korean Commercial Arbitration Board
- Lead trial counsel for a European company in an arbitration before the Korean Commercial Arbitration Board arising from a $400 million power plant project. The Arbitral Tribunal rejected the opposing party’s claims for over $45 million and awarded substantial costs in favor of the European company.
American Arbitration Association
- Represented Fujitsu Ltd in a very large international arbitration with IBM involving computer software copyrights.
Federal Court Litigation
- Second chair for trial of a patent infringement action in federal district court for a U.S. computer company. Shortly before submitting the matter to the jury, the district court granted summary judgment in favor of our client.
- Represented a European smart card company in a patent dispute with a U.S. company. The dispute was settled on favorable terms.
- Represented a U.S. manufacturer in a patent dispute with a key competitor. The dispute was settled on favorable terms, after we developed strong evidence that the patent was invalid.
- Represented a European company in the appeal of a judgment of willful patent infringement. The Federal Circuit reversed the district court judgment, concluding that the finding of willful infringement was clearly erroneous.
- Represented large Japanese manufacturer in federal court lawsuit brought by a downstream purchaser. Obtained dismissal of purchaser’s tort claims on the ground that they were barred by the limitations in the parties’ contracts.
- Obtained summary judgment for large U.S. newspaper on multi-million dollar libel and tort claims.
California State Cour t
- Successfully defended the American Arbitration Association in a lawsuit brought by the losing party to an arbitration. The trial court granted a demurrer on the ground of arbitral immunity, which was affirmed by the California Court of Appeal.
- Obtained summary judgment for Korean community newspaper on libel claims filed by insurance agent, who alleged that he had been falsely accused of insurance fraud.
