Kim Seneker's practice is devoted primarily to commercial real estate transactions, secured debt restructuring and creditors' rights, and environmental law, zoning and land use regulation. He has negotiated and documented a large number of substantial real property transactions, including acquisition, disposition and exchange of commercial real estate properties, sales and acquisitions of portfolios of real estate properties and loans, sophisticated lease financings, large-scale project development and construction agreements, commercial ground and occupancy leases, secured real estate financing transactions, and project joint ventures and partnerships.

Mr. Seneker has appeared before governmental agencies relating to the permitting and regulation of real estate developments and industrial projects, and has advised clients with respect to permitting and environmental requirements relating to commercial and industrial operations and facilities.

Professional Associations: Member and Past President, American College of Real Estate Lawyers; Member, American College of Mortgage Attorneys, Anglo-American Real Property Institute, and Lambda Alpha National Land Economics Society. Who's Who Legal has named Carl "Kim" Seneker its 2005 global Real Estate Lawyer of the Year, as determined through peer nominations and interviews. In addition, Mr. Seneker is listed in The Best Lawyers in America (2005-2007) as a leader in the field of Real Estate law.

Mr. Seneker served as a law clerk to Associate Justice William O. Douglas of the United States Supreme Court during the 1967-68 term. He associated with Morrison & Foerster in 1971 and became a partner in 1975.



Representative Matters
  • Represented Divco West Properties in negotiating and closing an acquisition agreement and ground lease for the Clift Hotel in San Francisco, and subsequently represented Divco in the sale of the property.
  • Represented Tokyu Corporation of Japan in the sale of the Pan Pacific Hotel in San Francisco to a company co-owned by Oxford Lodging and a major New York-based investment bank, and represented Pan Pacific Hotels, an affiliate of Tokyu, in negotiation of a Management Contract for the continuing operation of the Hotel as part of the Pan Pacific Hotel chain.
  • Represented Classic Residence by Hyatt in the ground leasing, development, financing and construction of a large, high-end, continuing care residential retirement community in Palo Alto, California, including the negotiation of a long-term ground lease with Stanford University and the documentation of construction financing for the facility obtained from a syndicate of major banks.
  • Represented Perry/Arrillaga in the sale of a $1 billion-plus portfolio of properties in the South Bay region to RREEF.
  • Represented affiliates of Pritzker Realty Group in the disposition of their ownership interests in two large apartment complexes aggregating approximately 700 units in Thousand Oaks, California.
  • Represented a Hines affiliate in acquiring four major office properties in the San Francisco Bay Area from Equity Office Properties.
