Mr. Falk is a partner in the San Francisco office of the law firm of Morrison & Foerster LLP. He is currently Chair of Morrison & Foerster’s Land Use and Environmental Law Group, has previously served as Chair of the American Bar Association’s Standing Committee on Environmental Law, and is a “Best Lawyer in America” and Northern California “Superlawyer” in the field of environmental law. In addition to his legal practice, Mr. Falk also has extensive government and policy experience at the federal, state, and local levels.
Among other areas, Mr. Falk focuses his current practice on counseling and defending clients in litigation with respect to California’s Proposition 65, Unfair Competition Act, Consumer Legal Remedies Act, and various other class action and toxic tort claims. Mr. Falk has defended a variety of companies in trial and appellate proceedings in courts throughout California and represented them in related settlement negotiations and in a variety of administrative and legislative proceedings.
Mr. Falk’s clients in these types of matters have included, among others, Hershey Foods Corporation , J.C. Penney Co. , Newell Rubbermaid, Inc. , Masco Corporation , Mars, Incorporated , Matsushita/Panasonic , Hallmark , Michaels’ Stores , Cooper Industries , Royal Doulton USA , and Mikasa, Inc . His opponents have included the California Attorney General, various District and City Attorneys, the National Resources Defense Council, Mateel Environmental Justice Foundation/Klamath Environmental Law Center, American Environmental Safety Institute, Consumer Advocacy Group, Center for Environmental Health, Public Media Center, As You Sow, Michael DiPirro, Whitney Leeman, Russell Brimer, Paul Dowhal and their associated counsel (e.g., Milberg Weiss Lerach, Altschuler Berzon, Bushnell Caplan, and the Chanler-Hirst, Lexington, Carrick, Packard, Freund, Mehrban, Ghalchi and Yeroushalmi law firms).
In addition to defending enforcement and citizens’ actions, Mr. Falk regularly counsels clients on Proposition 65, Business & Professions Code section 17200/17500, and environmental advertising/marketing compliance matters. He currently serves as Proposition 65 counsel to a variety of businesses and to trade associations such as the Coalition for Safe Ceramicware and the International Crystal Federation .
Beyond his Proposition 65 practice, Mr. Falk is a leading legal practitioner in federal Clean Water Act permitting and enforcement/citizens’ suit matters and in related surface and groundwater regulatory aspects of California’s Porter-Cologne Water Quality Act. Other areas of Mr. Falk’s practice include assisting clients with hazardous waste regulation, CERCLA/Superfund/ Natural Resources Damages claims, mold-related claims, and environmental liabilities in real estate and other business transactions.
Mr. Falk attended the Boalt Hall School of Law at the University of California at Berkeley. He was awarded his J.D. and admitted to the California Bar in 1989. He holds a Masters in Public Administration degree from New York University and a Bachelor’s degree in Economics from the State University of New York. He also frequently speaks and writes on a variety of consumer and environmental law topics and has chaired several international conferences on environmental law and trade issues.
