J. Michael Stusiak's practice presently focuses on complex litigation concerning intellectual property rights, lender liability claims and other contract and tort claims involving commercial enterprises. He has represented parties in commercial disputes (including bankruptcy proceedings), land use and environmental disputes, mass-tort products liability litigation and other matters. He has extensive experience litigating commercial contract disputes and disputes concerning distressed commercial real estate and related lender liability claims. Mr. Stusiak has represented parties in the successful resolution of matters through trial, appellate and alternative dispute resolution procedures.
Mr. Stusiak is a member of the American Bar Association, the Sacramento County Bar Association, the Federal Bar Association and the Association of Business Trial Lawyers. He is the co-author of An Overview of Bankruptcy Issues Affecting Partnerships, a Morrison & Foerster publication presented at the 1991 California Bankruptcy Forum Annual Meeting.
Mr. Stusiak associated with the firm in 1989 and was elected to the partnership in 1997.
Representative Matters
- Defense of Minnesota Mining and Manufacturing Company in nationwide breast implant products liability litigation.
- Successful defense of a church construction project challenged on CEQA grounds, including First Amendment issues, through the California Court of Appeals. Neighbors of Cavitt Ranch v. County of Placer , 106 Cal.App.4th 1092 (2003).
- Counsel for Amicus Curiae the Anti Defamation League in Catholic Charities of Sacramento, Inc. v. Superior Court , 32 Cal.4th. 527 (2004)., advocating that the State of California should retain strict scrutiny as the standard of review for whether government regulation infringes the right to free exercise of religion arising under the California Constitution.
- Defense in federal district and appellate courts of a major insurance company contesting a nine-figure lender liability claim alleging that the lender violated a joint venture agreement when it foreclosed on a defaulted loan.
