Mr. Bergin, a litigation partner resident in the firm’s New York office, was born in Brooklyn, New York in 1952. He received his B.A. degree, magna cum laude , from Columbia University in 1974, an M.A. in Musicology in 1978, and his J.D. degree in 1988 from Columbia University School of Law, where he was Senior Editor of the Columbia Law Review and a Harlan Fiske Stone Scholar. In 1988, Mr. Bergin also completed Columbia University’s Parker Program in International and Foreign Law, receiving Recognition of Achievement with Honors. After graduation from law school, Mr. Bergin was an associate at Simpson Thacher & Bartlett, and then served as law clerk to the Honorable Raymond J. Dearie, U.S. District Court Judge, Eastern District of New York, from 1989 to 1990. Mr. Bergin joined Morrison & Foerster as an associate in March of 1991, and became a partner in January 1997.
Mr. Bergin’s practice focuses on the management of complex commercial and consumer litigation, with emphasis on disputes involving multi-district and multi-state litigation and discovery. Mr. Bergin’s practice has involved a wide variety of legal issues, including consumer class actions, product liability litigation, financial service litigation, privacy litigation, RICO, insurance, tax, contract, and other issues. Mr. Bergin represents Bank of America in Hilton v. Bank of America , a Texas class action involving indirect auto financing. He represents Sankyo in various product liability actions involving the diabetes drug Rezulin. Mr. Bergin has represented and advised various clients on Internet and financial privacy matters. Mr. Bergin has represented Travelers Indemnity Company for several years in various insurance disputes. He served as court-appointed liaison counsel in Gold Fields American Corp. v. Aetna Casualty & Surety Co. , a complex environmental insurance dispute, from 1994 to 1997 and in Marisol, Inc. v. Travelers Indemnity Co. , another large environmental insurance dispute, from 1995 to 1999. Mr. Bergin has advised clients on consumer safety issues and represented manufacturers in matters before the Consumer Products Safety Commission.
Mr. Bergin has worked as pro bono co-counsel with the NOW Legal Defense and Education Fund on reproductive rights matters for several years.
Mr. Bergin is a member of the American Bar Association, the Association of the Bar of the City of New York, and the New York State Bar Association. He is a member of the Executive Committee of the Commercial and Federal Litigation
Section of the New York State Bar Association, and serves as Co-Chair of the Commercial and Federal Litigation Section’s Committee on New York Civil Practice Law and Rules.
