Gregory B. Koltun is engaged in a complex business litigation practice focused on antitrust litigation, and is Managing Partner of the Los Angeles Office. He has litigated cases in state and federal courts throughout the country in a variety of industries and fields, and has significant lead trial experience in complex business litigation.

In the antitrust field, Mr. Koltun has been involved in the defense of large-scale actions involving major international corporations, including nationwide consumer class actions alleging antitrust violations. He has also provided ongoing counseling to clients on a wide range of antitrust issues. Examples of the types of antitrust matters he has handled and is handling include the following:

  • Represented global transportation provider in defense of Section 2 monopolization case brought by competitor alleging anticompetitive practices, which resulted in voluntary dismissal without compensation of any kind;
  • Represented corporation in nationwide consumer class actions combined as part of multidistrict litigation, alleging tying claims and other violations of Section 2, which were settled for nominal payment;
  • Represented franchisor in class action franchisee litigation alleging violations of Sections 1 and 2, and successfully moved for dismissal of antitrust claims with prejudice at outset of litigation;
  • Ongoing representation of major financial institution in group of nationwide consumer class actions challenging banking fees;
  • Ongoing representation of global transportation provider in set of over 40 nationwide class actions alleging conspiracy to fix fuel surcharge levels on ground shipments.

Aside from class actions in the antitrust context, Mr. Koltun also has defended many class actions in other fields. In the consumer class action area, for example, Mr. Koltun has handled breach of contract, fraud, false advertising, and unfair trade practice cases involving financial institutions, transportation companies, and insurance companies, among others.

Mr. Koltun also regularly handles cases involving financial statement issues, including disputes over complex accounting, auditing, and taxation issues in professional liability cases, and disputes concerning stock and asset purchase agreements.

Mr. Koltun received his Bachelor’s Degree in Economics, magna cum laude and Phi Beta Kappa, from Claremont McKenna College in 1984. He is a 1987 graduate of the University of Chicago Law School, where he was Symposium Editor for the University of Chicago Legal Forum. He then served as law clerk to the Honorable Harry L. Hupp, United States District Court, Central District of California. He joined Morrison & Foerster in 1991.
