Tony Rodriguez is a litigation partner in the San Francisco office. Mr. Rodriguez has represented corporations, board committees, and individuals in securities litigation, derivative actions, and special investigations. He also has represented parties in telecommunications, energy, and eminent domain litigation. Mr. Rodriguez’s matters have included:
- Defending companies and individuals in shareholder class actions and derivative suits in a range of industries (e.g., Countrywide Financial Corporation, (ten former outside directors), Applied Micro Circuits Corporation (former Chairman, CEO and President),VeriFone (former CFO), Hewlett-Packard (former chair), Madge Networks, Network Computing Devices, Inc., DSP Group, Micro Focus, Intershop, Metricom (outside directors), Scios, Calpine, Neoforma, ABBI, Harmonic, Tempur-Pedic (two outside directors).
- Representing special committees and audit committees in reviews of stock option grants, stock sales, and other events.
- Representing Pac-West Telecomm, Inc., in a dispute with Verizon in which the central issue was whether Pac-West owed Verizon a multimillion dollar sum for “reciprocal compensation” payments for ISP-bound traffic that the CPUC purportedly should not have authorized. The district court granted summary judgment in favor of Pac-West and the Ninth Circuit affirmed. Mr. Rodriguez argued the case in both courts. Verizon California, Inc., v. Peevey, 462 F.3d 1142 (9th Cir. 2006).
- Representing Pac-West in Pacific Bell’s appeal to the federal district court of a CPUC decision requiring payment of a “reciprocal compensation.” Pac-West won summary judgment at the district court and the Ninth Circuit affirmed. Mr. Rodriguez argued the case in both courts. Pacific Bell v. Pac West Telecom, Inc., 325 F.3d 1114 (9th Cir. 2003).
- Representing a nationwide retailer suing an electric service provider for its breach of an agreement covering the client’s 200+ California stores and offices.
- Representing individual and corporate property owners in condemnation proceedings brought by various Bay Area agencies.
