Mr. Fox is involved in a broad-ranging trial level and appellate practice, and has extensive experience in complex copyright, trademark, trade secret and patent disputes, and in securities fraud, First Amendment, and class action litigation, among other areas of practice. He regularly is involved in high stakes or “bet-the-company” litigation as a member of the firm’s Intellectual Property and Consumer Class Action Litigation groups. His industry experience includes representing clients in the online travel industry; media, sports ventures and gaming; medical devices and health care; financial services; transportation; education; prescription drug claims processing; and real estate.
He has substantial experience in the federal and state appellate courts, including appeals in the First, Ninth, Tenth, and Federal Circuit Courts of Appeals, the California Supreme Court, and various districts in the California Courts of Appeal. He is a member of the Los Angeles County Bar Association’s appellate courts and state appellate judicial evaluation committees.
Mr. Fox maintains an active pro bono practice and currently chairs the Los Angeles office’s Pro Bono Services Committee. He received the ACLU’s Pro Bono Advocacy Award for his work on Williams v. State of California , a statewide class action challenging substandard conditions in California’s public schools.
Mr. Fox joined Morrison & Foerster in 1997 following graduation from the UCLA School of Law, where he was elected to the Order of the Coif. He became a partner in the firm in 2006.
Representative Matters
- Oakland Raiders v. Oakland-Alameda County Coliseum, Inc. , 144 Cal. App. 4th 1175 (2006). Member of appellate team that represented the Oakland-Alameda County Coliseum, obtaining reversal of a $34.2 million judgment following a lengthy trial.
- Sproul v. Oakland-Alameda County Coliseum , No. A104542 (Cal. Ct. App. Aug. 15, 2005). Successfully defended the City of Oakland, County of Alameda ,and the Oakland-Alameda Coliseum against alleged class and representative claims arising out of the sale of Personal Seat Licenses for Oakland Raiders home games.
- Lumenis v. Syneron , No. 02-8269 (C.D. Cal. 2004). Represented Syneron in patent litigation involving the company’s proprietary ELOS technology used in non-invasive medical aesthetic devices.
- Kling v. Hallmark Cards , No. 01-55902 (9th Circ. May 13, 2003). Successfully defended entertainment studios against claims for alleged copyright infringement in scripts to animated television series.
- Paulson v. Jefferies & Co. , No. 98-2644 (C.D. Cal. 2002). Defended owners of two Las Vegas hotel/casinos against alleged securities fraud and state law claims arising out of contracts for purchase of the properties.
