Ms. Garland’s practice focuses on representing companies and their officers and directors in all aspects of securities litigation, including internal investigations, securities class actions, derivative suits, and SEC investigations. In addition, Ms. Garland litigates antitrust and other complex civil cases. She represents clients in a range of industries, including telecommunications, biotechnology, financial services, software, and consumer goods.

In 2008, Ms. Garland received an Attorney of the Year Award from California Lawyer for her successful defense at trial of JDS Uniphase Corp. and its former executives. She also has been named one of California’s Top Women Litigators by The Los Angeles Daily Journal.

Notable Results

  • In re JDS Uniphase Corp. Securities Litigation (N.D. Cal.; filed Mar. 2002; judgment entered March 2008): Won jury verdict for defendants on all claims in a securities class action seeking $20 billion in damages for alleged fraud and insider trading.
  • In re Harmonic Inc. Securities Litigation, 163 F. Supp. 2d 1079 (N.D. Cal. 2001), and 2002 U.S. Dist. LEXIS 26676 (N.D. Cal. Nov. 14, 2002), aff’d in part 152 Fed. Appx. 674 (9th Cir. Feb. 17, 2005): Achieved dismissal of all claims in this securities class action at the pleading stage; appellate court affirmed dismissal of fraud claims.
  • Kane v. Madge Networks N.V., 2000 U.S. Dist. LEXIS 19984 (N.D. Cal. May 26, 2000), aff'd mem., 2002 U.S. App. LEXIS 5204 (9th Cir. Mar. 27, 2002): Achieved dismissal of securities class action at the pleading stage; appellate court affirmed.
  • Haig v. Organic, Inc. (San Francisco Superior Ct.; filed Feb. 2000; judgment entered Nov. 2001): Won summary judgment for defendants in case alleging fraudulent valuation of stock options.
  • Kihle v. Oracle Corp. (San Mateo Superior Ct.; filed Dec. 1997; dismissed Oct. 2001): Plaintiffs dismissed this state law securities class action for no payment following discovery.
  • InnovaCom, Inc. v. Swiss American Sec. (N.D. Cal.; filed Feb. 2000; dismissed July 2000): Achieved dismissal at the pleading stage for underwriters in action alleging improper guarantee of fraudulent stock transactions.
  • Padnes v. Scios Nova, Inc., 1996 WL 539711 (N.D. Cal. Sept. 18, 1996): Achieved dismissal of securities class action at the pleading stage; plaintiffs withdrew appeal without any payment.

Personal Background

Ms. Garland associated with Morrison & Foerster in 1992 and became a partner in 1999. From 1991 to 1992, Ms. Garland served as a law clerk to the Honorable Edward R. Becker, U.S. Court of Appeals for the Third Circuit. In 1991, she received her J.D., with honors, from the University of Chicago Law School, where she was a member of the Law Review. She graduated with highest honors from the University of California at Berkeley in 1987.
