Emily A. Evans is a partner in the Palo Alto office of Morrison & Foerster LLP, where she is a member of the Litigation Department. Her practice focuses primarily on patent litigation and related counseling, representing clients in diverse technologies, including biotechnology, pharmaceuticals, optical microlithography, software, semiconductor devices, and pesticides. Ms. Evans also has been involved in several appeals to the Court of Appeals for the Federal Circuit in patent cases and has an active patent interference practice.
Recently, Ms. Evans was a member of the team representing Nikon Corporation in high-stakes patent litigation with ASM Lithography, Inc. concerning microlithography tools and methods used to manufacture semiconductor chips, which settled after the defendants paid Nikon $146M. Ms. Evans also represented the University of Rochester in patent litigation against Pfizer, Searle, and Monsanto relating to the “super aspirin” Cox-2 inhibitor Celebrex. Among Ms. Evans’ other notable representations was her representation for many years of the University of California in The Regents of the University of California v. Genentech , Inc. relating to the University’s patent to DNA for human growth hormone, which settled after trial with Genentech paying the University of California $200 M.
Ms. Evans is a 1991, cum laude , graduate of the Fordham University School of Law. She received a Ph.D. in Cell Biology from The Rockefeller University in 1986. In addition, Ms. Evans has undergraduate degrees in Chemical Engineering and Biology. Prior to attending law school, Ms. Evans worked at the Howard Hughes Medical Institute at The Rockefeller University as a Research Associate.
Ms. Evans is a member of the California and New York bars and is admitted to practice before several federal district courts, the Court of Appeals for the Federal Circuit, and the United States Patent and Trademark Office. She is a member of the American Bar Association and the American Intellectual Property Law Association. Ms. Evans was recognized by San Jose Magazine in 2001-2004 as one of the top litigation lawyers in Silicon Valley. In September 2004, she was recognized by San Francisco Magazine as a Northern California Super Lawyer in the area of intellectual property litigation.
