Mr. Collanton has focused his practice on complex commercial litigation and has represented clients in a variety of matters including cases involving consumer class actions, constitutional litigation, breach of contract, business torts, false advertising claims and unfair competition claims.
Mr. Collanton has appeared in state and federal courts throughout California and the United States. He has also practiced before the United States Patent and Trade Mark Office, representing clients in trademark disputes. Mr. Collanton is a member of the American Bar Association, the Contra Costa County Bar Association, and is a member of the California State Bar Conference of Delegates.
Mr. Collanton associated with Morrison & Foerster in 1999 and became a partner in 2004.
Representative Matters
- Representing clients in consumer class action cases alleging unlawful business practices in violation of California Business and Professions Code § 17200, false and misleading advertising in violation of § 17500, violations of the California Consumer Legal Remedies Act, and breach of warranty claims.
- Representing interstate optical chains in a federal constitutional challenge, under the dormant Commerce Clause, to California's restrictions on the commercial practice of optometry. See NAOO v. Lockyer, 2006 U.S. Dist. LEXIS 88427 (E.D. Cal. 2006).
- Representing independent power producers in contract, unfair competition, and antitrust actions against investor-owned utilities. Mr. Collanton was instrumental in securing the right, through injunction and summary judgment, of independent power producers to obtain access to the California energy markets independent of the investor-owned utilities.
- Defending various energy producers and power marketers in federal and state courts against claims brought by the California Attorney General asserting unfair business practices arising out of the sale and marketing of electricity into California. See California Ex. Rel. Lockyer v. TransCanada Power L.P., 110 Fed. Appx. 839, 2004, U.S. App. Lexis 21727 (9th Cir. 2004).
- Representing out-of-state utilities and power marketers in breach of contract and declaratory relief actions arising out of power contracts. See Public Util. Dist. No.1 of Grays Harbor v. IDACORP, Inc. 379 F.3d 641 (9th Cir. 2004).
