David J. Murphy is a partner in the Palo Alto office of Morrison & Foerster LLP and a member of the firm’s Litigation Department as well as its Labor and Employment Law and Trade Secrets Practice Groups.

Mr. Murphy’s practice focuses on civil litigation in employment, labor and employee mobility matters. He has represented companies in all aspects of workplace employment disputes, including trade secrets, noncompetition and “employee raiding” matters; wrongful termination, harassment and discrimination litigation; wage and hour matters under state and federal law; ERISA litigation; and all aspects of union-related disputes. His experience includes extensive trial and appellate work in state and federal court and private arbitrations, as well as in class action claims for wage and hour, discrimination and ERISA matters.

Mr. Murphy also regularly counsels clients about actions needed to adhere to sound management practices in these same legal areas. He also has done extensive work on employment issues in mergers and acquisitions, including the issues involved in post-closing integration of multiple company workforces.

Mr. Murphy regularly has lectured and engaged in management training in all of these same legal areas, as well as for union avoidance strategies in a changing labor environment.

Mr. Murphy is a member of the American, California, and San Francisco and Santa Clara County Bar Associations.
