Rachel M. Wertheimer’s practice involves all aspects of complex commercial litigation, including arbitration, mediation and administrative proceedings. Ms. Wertheimer has litigated cases involving securities, insurance coverage, commercial contracts and consumer class actions. She has represented defendants in criminal investigations and trials, SEC proceedings and also has experience conducting corporate internal investigations.

Representative matters:

  • Represented officers and directors and companies in several large securities class actions, including in In re Metromedia Fiber Networks, Inc. Securities Litigation (S.D.N.Y.) and In re NetEase.com Securities Litigation (S.D.N.Y). Obtained a dismissal of one of two class action complaints in the MFN case.
  • Conducted internal investigations and represented targets of internal investigations involving accounting fraud, anti-money laundering regulations and the sale of certain financial products.
  • Represented equipment lease financers in two separate consumer class actions arising out of fees paid on equipment leases.
  • Represented a major insurance company in insurance coverage disputes involving environmental and toxic tort liability.

Ms. Wertheimer joined Morrison & Foerster in 2000. Before joining Morrison & Foerster, Ms. Wertheimer was with the firm of Anderson Kill & Olick, where she practiced in the area of insurance coverage litigation. Ms. Wertheimer received her B.A. in philosophy magna cum laude in 1993 from the University of Vermont and her J.D. cum laude from the University of Michigan School of Law in 1998. While at the University of Michigan, Ms. Wertheimer was an executive editor on the University of Michigan Law School Journal of Law Reform.
