Mr. Yang is a member of the Intellectual Property Practice Group, resident in the Los Angeles office of Morrison & Foerster LLP. Mr. Yang’s practice focuses on patents and includes litigation, reexamination, prosecution, licensing, infringement and validity analyses, due diligence, as well as transactional matters involving patent assets. Mr. Yang has worked with clients ranging from large multinational companies to startup companies and venture capital investors. He also has experience working abroad at various locations throughout Asia.
Mr. Yang received his B.S.E.E. from Arizona State University in 1994 with honors, and received his J.D. from the George Washington University Law School in 1998. During law school, Mr. Yang was a judicial extern to the Honorable Gladys Kessler of the United States District Court for the District of Columbia, and later to the Honorable Pauline Newman of the United States Court of Appeals for the Federal Circuit.
Some of the technologies Mr. Yang is experienced with include semiconductor processing, flat-panel display (TFT-LCD), GPS navigational systems, video and audio processing including post-production digital editing, optical disc-recording and writing, software encryption, electronic musical instruments, digital televisions, medical devices, and consumer electronics generally.
Mr. Yang’s representative engagements include:
- Apple, Inc. U.S.A.: Member of legal team that provides patent-related services to Apple, Inc.
- AU Optronics, Taiwan: Represented AU Optronics on several issues involving flat-panel display technologies. AU Optronics engages in the manufacturing of LCD panels.
- Goldman Sachs, China: Provided counsel to Goldman Sachs on technology-related investments in China, including conducting due diligence studies on intellectual property matters.
- Mitsubishi Electric Corporation, Japan: Provides legal advice to Mitsubishi Electric on patent and patent litigation matters relating to television and video reproduction technologies.
- Networks In Motion, U.S.A.: Represents Networks In Motion in all aspects of intellectual property law, including patent litigation and the prosecution of patent applications directed to mobile communication software applications. Networks In Motion provides wireless navigation solutions for GPS-enabled mobile communication devices.
- Playmates Toys, Inc., U.S.A.: Represents Playmates Toys on a variety of patent dispute matters involving toy electronic devices.
- Ricoh Corporation, Japan: Assisted Ricoh in its corporate acquisition of a Hitachi subsidiary by analyzing and evaluating the patent portfolio of the Hitachi subsidiary. Separately, assisted Ricoh in patent matters directed to DVD and DVD-R technologies.
- TDK Corporation, Japan: Provided advice to TDK in its acquisition of a PRC battery manufacturer, scope of responsibility included assessing patent infringement liability of the PRC battery manufacturer.
- TelASIC Communications, U.S.A.: Represents TelASIC in all aspects of intellectual property law, including the prosecution of patent applications directed to high-speed analog-to-digital and digital-to-analog converters. TelASIC provides analog, mixed-signal IC, and multi-band radio subsystems to wireless communication companies.
- Yamaha Corporation, Japan: Provides advice to Yamaha on patent and patent litigation issues. Prosecution of Yamaha’s patent applications in the area of music processing, digital music technologies, and optical disc recording technologies.
Mr. Yang’s litigation representations include:
- Digital Choice v. Changhong Electric Co. (China) et al.
Represented Changhong Electric Co., the largest Chinese consumer electronics company and third largest television maker in the world, in defending a patent infringement suit filed in the Eastern District of Texas. Case was successfully settled with the case voluntarily dismissed against Changhong and no money paid to the plaintiff. - Hopkins v. Analog Devices
Member of legal team that represented Analog Devices in defending against a patent infringement lawsuit relating to direct digital synthesis products. The case was successfully settled. - Interactive Music Technology LLC v. Roland Corp. et al.
Member of legal team representing co-defendant Yamaha Corporation in defending against patent infringement action filed by Interactive Music Technology. The asserted patents are directed to electronic musical instruments. - Mitsubishi Digital Electronics America, Inc. v. Guardian Media Technologies, Ltd.
Member of legal team representing Mitsubishi in patent litigation against patent holder, Guardian Media Technologies; the patents in suit are directed to video signal processing. Involved with the preparation and filing of ex parte reexamination requests for the two asserted patents. Both requests have been granted. - Multi-Format, Inc. v. Amazon.com, Inc.
Member of legal team that represented 12 major retailers in joint defense of litigation brought by Multi-Format, Inc., over DVD technology. Worked closely with the Motion Picture Association of America (MPAA) to search for and analyze prior art references that were used to support invalidity arguments against the Multi-Format patent claims. Plaintiff voluntarily dismissed its complaint. The firm has since filed a protest at the PTO in a related reissue proceeding involving the Multi-Format patent. - Plustek Inc. v. Syscan Inc., et al.
Represented Plustek Inc. in a declaratory judgment action in the Central District of California seeking a finding of non-infringement and invalidity with regard to patents relating to portable scanners. The case settled. - Vehicle IP LLC v. GM et al.
Currently represent co-defendants Verizon Wireless and Networks In Motion in defending against a patent infringement suit filed in the Western District of Wisconsin. Asserted patent is directed to GPS/navigational technology. Case is currently pending.
Mr. Yang was identified as a “rising star” in 2006 and again in 2007 by Southern California Super Lawyers, a publication that identifies a list of the top 2.5% of the attorneys in Southern California.
Aside from his patent practice, Mr. Yang regularly lectures at local high schools on the prevention of domestic violence and abusive relationships. Mr. Yang has received recognition from the Public Counsel Law Center for his contribution of free legal services to foster children, and in 2005 Mr. Yang was a recipient of the Wiley W. Manuel Award from the State Bar of California in recognition of his voluntary legal services to the local community.
Mr. Yang is admitted to practice in the state of California, before the U.S. District Court for the Central District of California, and is registered to practice before the United States Patent and Trademark Office. He was born and raised in Taiwan, and is fluent in Mandarin Chinese.
