David L. Fehrman, a partner resident in the firm’s Los Angeles office, handles patent prosecution, opinion, counseling and litigation primarily related to electronics, semiconductor, electromechanical, and software technologies. This includes counseling and litigation regarding issues of infringement and validity, regular participation in patent prosecution, and in appeal, reissue, and reexamination proceedings. In addition, Mr. Fehrman has argued before the Federal Circuit and has been lead attorney in six interferences before the U.S. Patent and Trademark Office. He wrote the patent and was one of the lead attorneys in the case of Odetics v. Storage Technology , which went through two successful appeals to the Federal Circuit and resulted in a $71 million verdict and a $100 million settlement for the patentee.
Mr. Fehrman has worked in the consumer electronics area for more than 25 years, including prosecuting nearly one thousand patents and preparing over one hundred opinions. He has been involved in numerous litigation matters on behalf of Yamaha Corporation, Mitsubishi Electric Corporation, the Motion Picture Association of America and EchoStar Corporation. He has worked with joint defense groups including substantially all television manufacturers in four cases regarding V-Chip parental control technology and digital television technology, and was a primary author of the successful summary judgment motion for non-infringement on behalf of Sony, Toshiba, Sharp, and Mitsubishi in the case of Sony Electronics v. Soundview Technologies .
Mr. Fehrman is also an active participant in the MPEGLA MPEG-2 and DVD-6C licensing pools, which have hundreds of licensees for DVD players and discs.
Mr. Fehrman obtained his B.E. degree from Vanderbilt University, magna cum laude , in 1974, and received his J.D. from Washington University in 1977. Prior to joining Morrison & Foerster, Mr. Fehrman was a partner at Graham & James LLP, where he was Chairman of the Intellectual Property Department. He was also a partner in the intellectual property boutique firm, Spensley, Horn, Jubas & Lubitz in Los Angeles.
Mr. Fehrman is admitted to practice in California and is registered to practice before the U.S. Patent and Trademark Office.
