Mr. Muhlbach has a general commercial litigation practice encompassing complex actions in the fields of unfair competition, false advertising, products liability, business torts, breach of contract, inverse condemnation and government tort claims. His practice emphasizes the defense of consumer class actions and product defect litigation against consumer electronics, computer hardware, software, and financial services companies.
Mr. Muhlbach associated with Morrison & Foerster in 2000 and became a partner in 2004. He previously associated with Robins, Kaplan, Miller & Ciresi, where his litigation practice focused on commercial disputes and product defect litigation.
Representative Matters
- Secured a $10 million summary judgment for breach of a contract concerning GPS-based wireless tracking and dispatch hardware and software.
- Secured a liability verdict on behalf of individuals and businesses against government agencies for damage caused by the flooding of the Pajaro River in Watsonville, CA ( Arreola v. County of Monterey , 99 Cal. App. 4th 722 (2002).). Post-appeal settlements in the case exceeded $45 million.
- Defended manufacturer of digital music players in multiple consumer class actions alleging product defect and false advertising claims.
- Defended software publisher in putative class action alleging claims of false advertising.
- Defended lenders in various consumer class actions alleging violations of RESPA, TILA, and state unfair competition laws.
- Represent notebook computer manufacturer in various consumer class actions alleging product defect and false advertising claims (pending).
