Mr. Ruby is Of Counsel at Morrison & Foerster LLP, joining the firm in 2000 after fourteen years of private and public legal work. He brings his expertise in Silicon Valley and South Bay planning, development, and infrastructure issues to the Land Use and Environmental Law Group.

Mr. Ruby graduated from UCLA, cum laude, in 1983 and Hastings College of the Law, magna cum laude, in 1986. After practicing as an associate at the law firm of Pillsbury, Madison & Sutro in San Francisco, he served 10 years as Senior Deputy City Attorney for the City of San Jose, during a decade of unprecedented growth and development.

While at the City of San Jose, Mr. Ruby provided direct legal counsel to the City Council, Planning Commission, City Manager, Redevelopment Agency, Planning Department, and Historic Landmarks Commission. His practice encompassed all aspects of the land development process, including permitting for industrial, commercial and housing development (market rate and affordable), the approval and implementation of redevelopment plans, transportation planning, and infrastructure issues. In addition, Mr. Ruby has specific expertise in infill development, redevelopment projects, the Subdivision Map Act, and the California Environmental Quality Act (CEQA). He frequently provides counsel on the defensibility of EIRs and developing legal and political strategies on highly controversial projects.

Mr. Ruby provided legal support for the complex issues surrounding development of the North San Jose high-tech sector and has overseen the permitting and approval process for over eight million square feet of industrial development, including permitting for Cisco Systems from its first building in San Jose to its redevelopment of the former Agnews Development Center site. Also, Mr. Ruby has assisted developers of biotechnology facilities in evaluating development opportunities and obtaining project approvals.

Mr. Ruby is also experienced with airport-related regulatory issues with the expansion of San Jose International Airport. Mr. Ruby worked extensively on the 1998 Airport Master Plan with city officials. He has assisted with negotiations, including the FAA and citizen groups, in connection with runway construction, terminal development, and transportation improvements.

Mr. Ruby has represented residential, commercial and industrial developers, property owners, and hospitals. He continues to work extensively on issues surrounding the development of Coyote Valley in San Jose, and drafted the new zoning code for the City of San Jose. He has represented the developer in the permitting and approval of a major residential community in Tuolumne County and has negotiated several Disposition and Development Agreements with Redevelopment Agencies. Mr. Ruby also assists hospitals in navigating the permitting and CEQA process.

Mr. Ruby is a regional leader on South Bay development issues, with a solid understanding of entitlement processing and local political dynamics. His extensive experience is frequently sought to assist residential, commercial, and industrial developers and public entities in navigating all phases of the land use regulatory process, especially the complex infrastructure, biological, and land use controversies common to Silicon Valley development.
