Mr. Davis specializes in patent litigation and interferences, as well as high stakes patent prosecution, including reexaminations, reissues and patent appeals. Mr. Davis also advises clients on a variety of strategic patent matters. In addition, Mr. Davis has extensive experience with intellectual property-related due diligence for mergers and acquisitions, technology transfer and licensing and patent validity, infringement, and freedom to operate opinions. He has worked in virtually all areas of technology, including biotechnology, pharmaceuticals, medical devices, electronic devices, software, and heavy machinery.

Mr. Davis has an A.B. from Cornell University, where he pursued interdisciplinary studies in biology and mechanical engineering. He received his J.D. from The Columbus School of Law at Catholic University in 1993.

Prior to joining Morrison & Foerster, Mr. Davis was an associate at Fulbright & Jaworski. L.L.P, and from 1990 to 1991 he was a Patent Examiner at the U.S. Patent & Trademark Office, examining both organic chemistry and biotechnology patent applications.



Representative Matters
  • Nikon v. ASML : Represented Nikon in a multinational patent dispute with ASML involving 18 patents relating to the manufacture of semiconductor wafers in which we achieved a favorable settlement for our client.

  • Stratagene v. Invitrogen Corp .: Currently representing Invitrogen in a patent case in the District of Maryland involving thermostable polymerases used to replicate DNA.

  • SuperGuide v. Thomson Consumer Electronics et al. Currently representing Thomson Consumer Electronics and Echostar in this patent infringement suit involving three patents in the area of satellite broadcast television technology. After winning summary judgment before the district court on all three patents, the case went to the U.S. Court of Appeals for the Federal Circuit, where summary judgment was affirmed on two of the three patents. The case has now been returned to the district court for disposition of the issues on the third patent.
