J. Manena Bishop is an associate in Morrison & Foerster’s Los Angeles office with a broad-based practice in the firm’s Intellectual Property Group. She represents clients in copyright, trademark, patent, trade secret, consumer class action, antitrust, unfair competition, and false advertising cases, among other areas of practice.

Ms. Bishop’s litigation practice involves representation of both plaintiffs and defendants in a wide range of complex matters in state and federal court. She has extensive experience in client counseling and all phases of litigation, including: case management, strategy and development, prelitigation investigation, discovery, law and motion practice, obtaining and opposing injunctive relief, damages analysis, expert witness preparation, depositions, settlement negotiations, mediation, trial, and appeals.

Ms. Bishop has submitted appellate briefs to the Federal Circuit. She recently wrote the appellate briefs in two separate Federal Circuit appeals involving issues of first impression. Both appeals resulted in precedential published opinions favorable to the clients:

Vas-Cath Corp. v. Curators of the Univ. of Mo., 473 F.3d 1376 (Fed. Cir. 2007)

Sony Elecs., Inc. v. Guardian Media Techs., Ltd., 497 F.3d 1271 (Fed. Cir. 2007)

Some highlights from Ms. Bishop’s representative matters include: defending a major studio against a purported false advertising and unfair competition nationwide class action; protecting the world’s largest winery’s mark against federal trademark infringement and dilution; enforcing all forms of intellectual property rights of an internationally syndicated children’s television character; defending a European telecommunications client in antitrust-related U.S. government investigation; protecting a global technology client against third-party violations of the Lanham Act, the Electronic Communications Privacy Act, and the Computer Fraud and Abuse Act.

In addition to her litigation practice, Ms. Bishop has handled all aspects of structuring, drafting, and negotiating license, distribution, outsourcing and services agreements. Her experience also includes international trademark and copyright counseling, registration, and prosecution. She also regularly advises clients from a range of industries in intellectual property, advertising, online marketing, and Internet-related issues.

Ms. Bishop maintains an active pro bono practice in which she performs a wide range of services. She is currently representing refugees in their application process for obtaining humanitarian parole and political asylum. In addition, she counsels local artists in their legal media-related rights and represents them in securing, protecting, and enforcing their intellectual property. Ms. Bishop has also litigated wage claim cases before the California Labor Commissioner, handled court proceedings for adopting parents, and helped local charitable organizations achieve nonprofit status.

Prior to joining Morrison & Foerster, Ms. Bishop served as an extern to the Honorable Clarence C. Newcomer of the United States District Court for the Eastern District of Pennsylvania. During her law school career, she also worked as a law clerk in private practice in the areas of complex commercial litigation, intellectual property, and entertainment.

Ms. Bishop received her J.D. from Boalt Hall School of Law, University of California, Berkeley where she served on the editorial board of the Berkeley Technology Law Journal as an executive editor. Prior to law school, she earned her B.A., cum laude, from Hamilton College and was elected to Pi Sigma Alpha as a political science honorary.

Ms. Bishop is a member of the State Bar of California. She is admitted to practice in all California State Courts, the United States District Courts for the Central, Eastern, and Northern Districts of California, as well as the United States Courts of Appeals for the Federal Circuit and the Ninth Circuit. She also holds memberships in numerous local bar associations and industry organizations.
