Mr. Amemiya’s principal expertise in antitrust/antimonopoly law is enhanced by a broad range of experience in international business transactions and corporate matters. He has also counseled clients in litigation matters for law firms in Japan and the United States. Mr. Amemiya previously served as Investigator at the Japanese Fair Trade Commission (“JFTC”), the competition authority in Japan. When he joined the JFTC in 2001 he was the first attorney it hired under a special law to offer legal expertise in JFTC’s investigations and administrative hearings and with his departure in 2004 is one of a small number of attorneys in private practice. He not only handled a number of cartel, monopoly, unfair trade practice and surcharge (kachokin) cases as well as merger reviews, but also lectured on various legal issues before JFTC executives and staff.
Mr. Amemiya played a leading role in cases involving cartel/bid rigging, private monopolization and unfair trade practices in the oil, construction, medical device, food and metal piping industries. These cases were some of the JFTC’s most challenging and notorious, resulting in model rulings on a number of key issues. He also participated in JFTC competition reviews related to the cellular telephone industry and the food container industry.
In addition to his specific case work, Mr. Amemiya directly advised the JFTC executives on all aspects of antitrust law and interacted with them regarding JFTC enforcement strategy, the practice of on-site investigations, and administrative suits and fines. Since he has joined the firm, a number of leading Japanese business organizations have looked to him to address their members on various JFTC-related issues such as the key methods which the JFTC uses to regulate and investigate companies doing business in Japan, details and implications of the recent amendments to the Anti-Monopoly Act or the latest trends and predictions of the JFTC’s enforcement. Also, Mr. Amemiya has been actively working as a Non Governmental Advisor (“NGA”) for the International Competition Network (“ICN”), a forum for more than 80 national competition agencies worldwide. Currently, as the only Japanese NGA to serve under a long-term commitment, he is not only attending various ICN conferences and making presentations, but also advising JFTC and ICN committees on major issues such as merger review and cartel investigation from the private counsel viewpoint.
Mr. Amemiya has written or co-written several articles on the subject of antitrust law. In the winter 2003 special extended issue of Antitrust Report (Matthew Bender), he authored the article on the “Anti-Monopoly Act of Japan.” He is quoted often in domestic and international media. In the Global Competition Review and PLC Global Counsel Handbooks , he is listed as a highly recommended Japanese competition specialist.
Mr. Amemiya received his LL.B. degree from Chuo University in 1989 and his LL.M. degree from the University of Michigan Law School in 1998. He completed his studies at the Legal Training & Research Institute, and is admitted to practice law in Japan and New York. He is a member of the Tokyo Bar Association and the Japan Federation of Bar Associations, as well as the American Bar Association, New York State Bar Association and International Bar Association. He is also a member of the Antimonopoly Department of the Tokyo Bar Association and of the Competition Law Forum.
