San Francisco, CA--May 14, 2008 --Morrison & Foerster partners Terri Garland, Rachel Krevans, and Karen Kubin were named on the Daily Journal's "Top Women Litigators" list, the firm's best showing on the list. The Daily Journal takes an annual look at a year's worth of work and then names this list of most accomplished female litigators.
Their achievements, highlighted by the Daily Journal on the attached PDF, are also briefly described below:
Terri Garland has spent her entire career with MoFo and for the past five years has been representing fiber optic company JDS Uniphase Corp. in a $20 billion insider trading class action. The case finally ended in November, with an Oakland federal jury unanimously handing down a complete exoneration for the company and its four former senior executives. It was only the second defense verdict in a securities class action since the passage of the landmark Securities Reform Act in 1995.
Rachel Krevans divides her time between life sciences and technology patent litigation, representing both plaintiffs and defendants. Last year, she triumphed in a huge case filed in the Eastern District of Texas for her client, EchoStar Communications Corp., against Forgent Networks Inc. Forgent had accused EchoStar, along with many heavyweights of the consumer electronic industry, of patent infringement. Ultimately, Rachel and her MoFo team convinced a jury that Forgent's patent was invalid.
Karen Kubin joined Morrison & Foerster earlier this year and touts an unbroken record of defeating class certification in cases related to managers allegedly being cheated out of overtime wages. Last year, Karen successfully defended Brinker Restaurant Corp. in two lawsuits. In one, she persuaded a San Diego County Superior Court judge to deny class certification of 900 restaurant managers, who alleged they were misclassified as exempt from overtime. In another Brinker case, the judge held as a matter first of impression that there is no private right of action for violation of the state's tip pooling statute, paving the way for Karen to win a dismissal of the case on summary judgment.
Terri, Rachel, and Karen were honored along with the rest of the 75 women on this year's list at an awards reception in Beverly Hills on May 12th, 2008.
