Employment Law Commentary Update 10/2/07

In last week’s Employment Law Commentary on the Department of Homeland Security’s new regulation regarding Social Security No-Match letters (see Social Security No-Match Letters: Mass Firings or No Big Deal? (Homeland Security’s New Regulation Enjoined for Now, September 2007), we indicated that the regulation, meant to be effective September 14, 2007, had been enjoined by a federal judge in San Francisco until October 1 and that a hearing on continuing the injunction was scheduled for Monday, October 1, 2007.  That hearing was held and the judge extended the temporary ban on enforcing the regulation to October 10, 2007, when the judge is expected to make his final ruling.  We will send out another update as soon as the judge makes his final ruling.
