David Gold has dedicated his practice to land use, redevelopment, renewable energy, and CEQA matters before government agencies and commissions throughout Northern California. Mr. Gold advises public and private institutions, including renewable energy and mixed-use applicants, cities, counties, and hospitals, to guide them through all phases of the land use regulatory process and to find solutions to complex infrastructure issues and political controversies.
Mr. Gold has served as special land use counsel to public clients on general plan, specific plan, and CEQA matters. He has drafted numerous land use initiatives which have been adopted by the voters.
Mr. Gold has been active in major California land use legislative initiatives. He was selected as land use counsel to the Bay Area Council's CEQA Task Force and has testified before the Legislature on CEQA reform legislation. Mr. Gold was the only attorney selected for the Contra Costa County Climate Change-CEQA Task Force.
He also has written and lectured in the areas of CEQA, development agreements, transit-oriented development, the Global Warming Solutions Act (AB32), climate change issues, sustainable development, and green building matters.
Mr. Gold currently serves on the Executive Committee and Board of Directors of the Contra Costa Economic Partnership. He has been active in the Contra Costa County Bar Association, serving as the Chairman of its Real Estate Section. Mr. Gold has been recognized for his expertise in land use and zoning law by Legal 500 US and Best Lawyers in America. Since 2004, he has been named a Northern California Super Lawyer for Land Use/Zoning. In 2013, Mr. Gold received an AV Preeminent Peer Review Rating from Martindale-Hubbell for Energy, Environmental and Natural Resources. In 2011, the Daily Journal recognized Mr. Gold as one of the top 25 land-use attorneys in California.
Special Land Use Counsel to Kaiser Foundation Health Plan
Serve as special land use counsel to Kaiser Foundation Health Plan in the siting of its major hospital and medical office facilities throughout Northern California and the Central Valley. Since 1991, we have represented the company on all facets of its entitlements process, including CEQA advice, negotiation of development agreements, rezoning, and preliminary and final development plan approvals on more than a dozen of its medical facilities, including major Kaiser Permanente facilities in Oakland, Los Angeles, San Jose, Antioch, Emeryville, San Francisco, Vallejo, Santa Clara, San Rafael, Sacramento, Modesto, Vacaville, and Walnut Creek.
Apple Inc.'s New Cupertino Campus
Serving as land use, CEQA and natural resource permitting counsel to Apple in connection with a new, approximately 3.4-million-square-foot campus in Cupertino, California.
First Solar, Inc.
Advise FirstSolar, a major developer of utility-scale photovoltaic solar facilities, on environmental, land use, natural resource, and real estate aspects of complex solar permitting, transmission, and facility development, including compliance with NEPA and the CEQA, the federal and California Endangered Species Acts, the Williamson Act, and local zoning and related laws and regulations.
San Ramon City Center Project
Settled ensuing litigation in a quick and cost-effective manner and assisted Sunset Development Company with obtaining entitlements for its mixed-use, public-private partnership "City Center" project in San Ramon. The project consists of approximately 2.1 million square feet that include residential, retail, commercial, and civic components.
Northern California Land Use Counsel
Serve as land use counsel for The Blackstone Group, Equity Office Properties, and CarrAmerica Realty Corp., the largest owners of office buildings and business parks in the United States, on major land use entitlement matters throughout Northern California, including an approximately one-million-square-feet portion of the nine-million-square-feet Hacienda Business Park in Pleasanton, California, where we are seeking mixed-use approvals for office, hotel, and retail spaces. We represent these entities with the entitlement of a corporate campus and retail project in Santa Clara, California. We also advise these entities on the implications of climate change legislation, including strategies related to newly drafted guidelines for mitigating greenhouse gas impacts under CEQA and compliance with the sustainable communities provisions of SB 375.
BRE Properties’ Walnut Creek BART Project
Assist BRE Properties with the entitlement of a mixed-use, transit-oriented development project at the BART Station in Walnut Creek, California. This 16-acre site will be developed with a replacement parking garage for BART parking, a 30,000-square-foot commercial building, approximately 590 multi-family residential units, approximately 8,000 square feet of retail use, and associated parking.
Defensibility of General Plan for City of Antioch, CA
Represented the City of Antioch on the legal defensibility of its successfully adopted comprehensive citywide 2004 General Plan Update, the 2,700-acre Sand Creek Specific Plan, and the CEQA compliance covering these major planning efforts. We participated in strategic discussions with city staff, planning commissioners and city councilmembers, and negotiated with potential litigants.
Lennar Mare Island
Assist Lennar Corporation and LNR Property Corp. in the development and reuse of the 5,200-acre Mare Island Naval Shipyard in Vallejo, California. The Mare Island Reuse Plan includes 1,400 homes and roughly 7 million square feet of commercial and industrial space. We have had extensive involvement counseling Lennar and the City of Vallejo on CEQA and NEPA compliance and the legal defensibility of an EIR/EIS for this complex project.
John Muir Health’s Development Projects
Serve as John Muir Health’s land use, natural resources, and real estate counsel on all aspects of its capital program, including the entitlement and development of its major medical centers in Walnut Creek, Concord, and Brentwood, California. We also assist John Muir Health with the acquisition and leasing of property, as well as with its strategic master planning.
Twelve Bridges Development, Placer County
Represent Central Plot and represented its predecessor for more than 12 years on all major land use entitlements, CEQA bond financing, golf course operations, construction contracts, and partial sale of 5,000-acre newly developed mixed residential, golf, and commercial development. We are advising the master developer on program- and project-level CEQA compliance, including settlement of CEQA litigation.
Rancho San Juan, Monterey County
Obtained approval and settled numerous lawsuits for HYH Corporation related to its proposed development of a new planned community on 671 acres of undeveloped and agricultural land in the Rancho San Juan in Monterey County, north of Salinas. The project is part of the Rancho San Juan Specific Plan, the largest development project ever approved in Monterey County, consisting of up to 4,000 residential units, over 500,000 square feet of commercial/retail space, approximately 2.7 million square feet of light industrial and business park uses, and more than 240,000 square feet of office development on more than 2,500 acres.
Cleantech America’s Fresno Solar Project
Represented Cleantech America LLC on the land use siting, permitting, environmental, tax, and real estate aspects of a 400-megawatt solar photovoltaic power plant project proposed on approximately 2,860 acres in Fresno County, California.
