Aerospace and Aviation

An important aspect of Morrison & Foerster’s product liability practice is the defense of aircraft manufacturers, airlines, fixed-base operators, pilots, and airports, in claims arising from their operations. The firm handles cases of all sizes and levels of complexity, ranging from transport-category aircraft accidents to lost bag claims.

Many of the attorneys who are members of the group have military or civil aviation backgrounds and are well acquainted with the technical aspects involved in each aviation case. Each partner in the group has tried aviation cases to verdict.

Members of the aviation group have been retained by fixed-base operators to defend claims relating to maintenance of general aviation aircraft, aircraft rental, flight instruction and flight operations. The firm has also been retained by governmental entities operating airports to defend claims for personal injury and property damage relating to crashes or operations on or near airport property, by aircraft owners to prosecute claims against aircraft modifiers under supplemental type certificates, and by pilots contesting FAA certificate revocation actions.

Industry Focus

The Product Liability Group routinely works with aircraft manufacturers, major air carriers, and insurers, including Global Aerospace, Amlin, Underwriters at Lloyds of London, AIG, and United States Aviation Underwriters. In each case, the focus is on the delivery of superior legal services in a cost-effective manner. A premium is placed on communication and coordination with the client and insurer in order to understand the problem, identify the litigation objectives, and establish an efficient plan for the successful resolution of the case. Our firm also provides risk management and litigation avoidance counseling to companies in the aviation industry.
