Advanced DIP Topics

Lorenzo Marinuzzi, Partner and Global Co-Chair of Business Restructuring & Insolvency at Morrison Foerster, presented at the ABI New York City Bankruptcy Conference on a panel titled "Advanced DIP Topics." Topics included recent DIP financings involving nonconsensual financings as well as some novel provisions that are now common in DIP orders. Panelists discussed the status of priming DIP financings/nonconsensual uses of cash collateral, as well as recent developments in DIP-financing orders, including limitations on the challenge period and "interim order creep."
