Recent disagreements among federal courts that have impacted the federal class action landscape;
Recent decisions applying the Supreme Court’s personal jurisdiction jurisprudence in Bristol-Myers Squibb, Goodyear Dunlop, and Daimler AG to the class and collective action context;
Recent opinions deciding whether class certification is proper where some class members may not have been injured;
The brewing circuit split on the question of whether the requirements of Rule 23(b)(3) must be satisfied before a class can be certified under Rule 23(c)(4); and
Whether the varying opinions can be harmonized and how they might impact strategies for opposing or advancing class certification.
