James Koukios spoke to Global Investigations Review about the arbitration rulings against Australian engineering company Worley. He said that the Department of Justice (DOJ) often uses disputes like the Worley arbitration ruling as leads for criminal investigations. While arbitration proceedings are rarely made public, the DOJ regularly finds interesting information in civil litigation.
James added, “Though the DOJ wouldn’t be able to use any of the tribunal’s findings as evidence before a criminal court, prosecutors could potentially rely on the underlying documents and witness testimony.”
