The state of Idaho has enacted laws and/or issued guidance on Artificial Intelligence (AI). Companies subject to Idaho law should be familiar with all relevant AI-related laws, regulations, and guidance, including those listed below.
The Law regulates the use of pretrial risk assessment algorithms, requires transparency, requires that all information used to build or validate the pretrial risk assessment tool be open to public for inspection, auditing, and testing; prevents the builder or user of a pretrial risk assessment tool from asserting trade secret or other intellectual property protections in order to quash discovery of such materials.
The Law provides that a person is guilty of disclosing “explicit synthetic media” where specific criteria apply. The Law does not apply to an interactive computer service, an information service, or a telecommunication service, for content provided by another person, unless the provider intentionally aids or abets disclosing explicit synthetic media.
