The state of Maryland has enacted laws and/or issued guidance on Artificial Intelligence (AI). Companies subject to Maryland law should be familiar with all relevant AI-related laws, regulations, and guidance, including those listed below.
Laws and Regulations
General
This law provides that a person may not knowingly, willfully, and with fraudulent intent use AI or a deepfake representation to cause harm to another by impersonating, falsely depicting, or claiming to represent that person or any other person.
Employment
The Law prohibits employers from creating a facial recognition template during an applicant's interview unless the applicant consents.
Health Care
This Law requires that certain carriers, pharmacy benefits managers, and private review agents ensure that AI, algorithm, or other software tools are used in a certain manner when used for conducting utilization review.
Elections
This law prohibits, absent an applicable exception, a person from knowingly or with reckless disregard, creating, using, or disseminating a deepfake to produce materially false information if, among other things: (i) the person has the intent to use the deepfake to impede, influence, prevent, or attempt to do so, a voter’s decision to cast a ballot; and (ii) the creation, use, or dissemination of the deepfake results in harm to a vote, potential voter or petition.
