
Mexico has introduced pending legislation on Artificial Intelligence (AI). Companies subject to the laws of Mexico should be familiar with all relevant AI-related laws, regulations, and guidance, including those listed below.
The proposed decree would amend the Federal Penal Code, penalizing the misuse of AI tools . Sanctioned behaviors include the manipulation of audiovisual content to disseminate false, confidential, or reserved information without authorization; the use of facial and biometric recognition technologies without consent or with illicitly extracted private data; the dissemination of confidential information or private content without authorization; and the generation of unidentified content created with AI.
In addition, it would amend the Federal Copyright Law to include among the works subject to protection those that have been assisted by AI tools. Creations made with AI that infringe pre-existing works, that do not have authorization, that are generated autonomously by AI and that do not identify the sources or technology used will not be subject to protection.
The Bill would establish a regulatory framework for the development, implementation, use, supervision, and promotion of AI in Mexico.
The proposed law aims to establish a legal framework to regulate the development, deployment and use of Artificial Intelligence systems (AI) in the country. The law would designate the Federal Institute of Telecommunications (IFT) as the competent authority on AI matters and establish the National Commission on Artificial Intelligence as an advisory body to the IFT.
