Elections

The following law applies in the context of elections in Mississippi.

The Law provides that a person who disseminates a “digitization” or enters into a contract or other agreement to disseminate a digitization is guilty of a crime and may be sentenced as provided in the law, if the person knows or has actual knowledge that the item being disseminated is a digitization and the dissemination meets specified criteria. “Digitization” means to alter an image or audio in a realistic manner utilizing an image or audio of a person, other than the person depicted, computer-generated images or audio, commonly called deepfakes.  "Digitization” also includes the creation of an image or audio through the use of software, machine learning AI or any other computer-generated or technological means.  The Law exempts certain entities, including, for example, an internet website or service provider that routinely carries news and commentary of general interest and that publishes any digitization prohibited by the law, if the publication clearly states that the election communication, including materially deceptive media, does not accurately represent a ballot issue or candidate.
