The state of Montana has enacted laws and/or issued guidance on Artificial Intelligence (AI). Companies subject to Montana law should be familiar with all relevant AI-related laws, regulations, and guidance, including those listed below.

Laws and Regulations

This amends laws related to crimes against children, including revising the offense of sexual abuse of children to include computer-generated child pornography.

This law provides that when critical infrastructure facilities are controlled in whole or in part by a critical AI system, the deployer must develop a risk management policy after deploying the system that is reasonable and considers specified guidance and standards.

This law criminalizes the use of real and digitally fabricated sexually explicit images. 

This revises laws related to the name, voice, and likeness of individuals and creates penalties. 

This law creates the crime of disclosing certain explicit synthetic media, i.e., deepfakes.

Elections

The following law applies in the context of elections in Montana.

This revises the state’s election laws to regulate the use of deepfakes in election communications and electioneering communications.
