The state of Oregon has enacted laws and/or issued guidance on Artificial Intelligence (AI). Companies subject to Oregon law should be familiar with all relevant AI-related laws, regulations, and guidance, including those listed below.
Laws and Regulations
General
This law requires operators of AI companions and AI companion platforms to provide notice to users that the users are interacting with artificial output if a reasonable person that interacts with the AI companion or AI companion platform would believe that the person was interacting with a natural person.
Elections
The following law applies in the context of elections in Oregon.
The Law provides that a campaign communication that includes any form of “synthetic media” must include a disclosure stating that the image, audio recording or video recording has been manipulated. “Synthetic media” is defined as an image, audio recording or video recording of an individual’s appearance, speech or conduct that has been intentionally manipulated with the use of AI techniques or similar digital technology in a manner to create a realistic but false image, audio recording or video recording that produces: (i) a depiction that a reasonable person would believe is of a real individual in appearance, speech or conduct but that did not actually occur in reality; and (ii) a materially different understanding or impression than a reasonable person would have from the unaltered, original version of the image, audio recording or video recording. The Law exempts certain entities when specific conditions apply, such as where a communication includes a statement that the synthetic media contained therein does not accurately represent a ballot issue or candidate.

This Guidance addresses how some of Oregon’s laws may apply in the AI context. The state laws that the Guidance specifically focuses on are: the Unlawful Trade Practices Act, Consumer Privacy Act, Consumer Information Protection Act, and Equality Act.
